Terms of Service

Welcome to Runix. These Terms of Service ("Terms") govern your access to and use of the Runix cloud deployment platform, including our website, APIs, CLI tools, and related services (collectively, the "Service"), operated by Runix ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Terms

To use the Service, you must create an account by providing accurate and complete information. You may register using a valid email address or through GitHub OAuth. You must be at least 16 years of age to create an account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials, including passwords and API keys.
  • All activity that occurs under your account, whether or not authorized by you.
  • Notifying us immediately at legal@runixcloud.dev if you suspect unauthorized access to your account.
  • Ensuring that your use of the Service complies with all applicable laws and regulations.

We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for an extended period, or are used for fraudulent purposes.

2. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service in any manner that violates the Acceptable Use Policy, including but not limited to deploying applications that engage in cryptocurrency mining, network abuse, or distribution of illegal content.

3. Service Description

Runix is a cloud deployment platform that provides:

  • Application deployment — automated building and deployment of web applications from Git repositories with AI-powered Dockerfile generation.
  • Container management — Docker-based container orchestration, including automatic scaling, health checks, and restart policies.
  • Custom domains — provisioning of custom domains and subdomain-based routing with automatic TLS certificates.
  • Environment management — secure environment variable storage and injection for deployed applications.
  • CI/CD pipelines — automated build and deployment pipelines triggered by Git pushes and webhooks.
  • Monitoring and logs — real-time build logs, deployment logs, and application metrics.

We may modify, update, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of significant changes that may affect your use of the Service.

4. Billing and Payments

Certain features of the Service require a paid subscription. By selecting a paid plan, you agree to the following:

  • Subscription plans — we offer various subscription tiers with different resource allocations, features, and pricing. Current plans and pricing are available on our Pricing page.
  • Payment processing — all payments are processed securely through Stripe. We do not store your full payment card details on our servers.
  • Auto-renewal — subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date.
  • Price changes — we may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • Refund policy — subscription fees are generally non-refundable. However, if you experience a significant service outage or billing error, you may request a pro-rated credit by contacting legal@runixcloud.dev. Refund requests are evaluated on a case-by-case basis.
  • Overages — if your usage exceeds your plan's allocated resources (build minutes, bandwidth, or storage), you may be charged overage fees or your service may be throttled, depending on your plan configuration.

5. Data Ownership and Intellectual Property

You retain all rights, title, and interest in your code, applications, data, and content that you deploy or store on the Service ("Your Content"). Runix does not claim ownership of Your Content.

By using the Service, you grant Runix a limited, non-exclusive, worldwide license to access, store, process, and transmit Your Content solely as necessary to provide the Service to you. This license includes the right to build Docker images from your source code, run your applications in containers, and create backups as part of normal operations.

All intellectual property rights in the Service itself, including the platform, software, documentation, branding, and any AI-generated Dockerfiles or configurations, remain the exclusive property of Runix.

6. Service Availability

We strive to maintain high availability of the Service. During the current beta period, we do not guarantee specific uptime targets. Uptime SLAs will be introduced when the platform exits beta. The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Service at all times.

Scheduled maintenance windows will be announced in advance when possible. We are not liable for any downtime, data loss, or service degradation caused by factors beyond our reasonable control, including but not limited to third-party infrastructure failures, network outages, or force majeure events.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Runix and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities.
  • Loss of data, goodwill, or other intangible losses.
  • Cost of procuring substitute services or technology.
  • Damages arising from your use of or inability to use the Service.
  • Damages arising from unauthorized access to or alteration of your data or transmissions.

In no event shall Runix's total aggregate liability to you exceed the greater of (a) the amount you paid to Runix for the Service during the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless Runix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content deployed on the Service.

9. Termination

By you: You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard settings. Upon termination, your running deployments will be stopped and your data will be deleted in accordance with our Privacy Policy. Prepaid subscription fees for the remainder of the current billing period are non-refundable.

By Runix: We may suspend or terminate your account immediately, with or without notice, if we determine that you have violated these Terms, the Acceptable Use Policy, or applicable law. In cases of minor violations, we will make reasonable efforts to notify you and provide an opportunity to remedy the issue before termination.

Upon termination, your right to access and use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes, as described in our Privacy Policy.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If you disagree with the updated Terms, you must stop using the Service and terminate your account before the changes take effect.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

12. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Runix regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: The failure of Runix to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. Runix may assign its rights and obligations without restriction.
